1. Acceptance of Terms

By accessing or using the AptLok website (aptlok.com) and any associated services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Platform.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and AptLok ("we," "us," or "our"). Your continued use of the Platform following the posting of any changes to these Terms constitutes acceptance of those changes.

2. Description of Service

AptLok is a real estate intelligence platform serving the Hyderabad metropolitan area and beyond. The Platform provides the following services:

• Property Listings: A marketplace for buyers, sellers, landlords, and tenants to list and discover residential and commercial properties.
• Locality Advisory: Data-driven locality guides, market analysis, and real estate intelligence for localities across Hyderabad.
• Newsroom: Curated and original real estate news, market updates, and editorial content relevant to the Hyderabad property market.
• MyAssociation (Community Management): A suite of tools for residential associations and communities to manage operations including payments, visitor management, complaints, notices, and member administration.

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without prior notice or liability.

3. User Accounts

Certain features of the Platform require you to create an account. Account registration is facilitated through Google OAuth and other authentication methods we may offer.

• You must provide accurate, current, and complete information during the registration process and keep your account information up to date.
• You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You must notify us immediately of any unauthorised access to or use of your account.
• You may not create multiple accounts for deceptive purposes, impersonate another person, or use another person's account without authorisation.

AptLok shall not be liable for any loss or damage arising from your failure to safeguard your account credentials.

4. Property Listings

Users who list properties on the Platform ("Listers") acknowledge and agree to the following:

• Accuracy: Listers are solely responsible for the accuracy, completeness, and legality of all information, images, and content included in their property listings. Misleading or fraudulent listings are strictly prohibited.
• Removal: AptLok reserves the right to edit, de-list, or remove any property listing at its sole discretion, without prior notice, for any reason including but not limited to suspected inaccuracy, policy violations, or legal concerns.
• No Transaction Guarantee: AptLok acts solely as an intermediary platform. We do not guarantee that any listing will result in a sale, purchase, lease, or rental transaction. All negotiations and transactions are conducted directly between the parties involved.
• Compliance: Listers must ensure their listings comply with all applicable laws and regulations, including the Real Estate (Regulation and Development) Act, 2016 (RERA), where applicable.

5. Advisory & Market Data

The locality advisory content, market data, price trends, neighbourhood insights, and any analytical information provided on the Platform are intended for general informational purposes only.

• Such information does not constitute financial, investment, legal, or professional advice of any kind.
• Market data and analytics may not reflect real-time conditions and may be subject to delays, inaccuracies, or omissions.
• You should independently verify all information and consult qualified professionals before making any real estate or financial decisions.
• AptLok makes no representations or warranties regarding the accuracy, reliability, or completeness of any advisory or market data presented on the Platform.

6. User Conduct

You agree not to engage in any of the following prohibited activities while using the Platform:

• Spam: Sending unsolicited messages, advertisements, or promotional content to other users through the Platform.
• Fake Listings: Posting fictitious, misleading, or duplicate property listings to deceive other users or manipulate search results.
• Scraping: Using automated tools, bots, crawlers, or scripts to extract, collect, or harvest data from the Platform without our prior written consent.
• Harassment: Engaging in abusive, threatening, defamatory, or otherwise objectionable behaviour toward other users, our team, or any third party.
• Interference: Attempting to interfere with, disrupt, or compromise the integrity, security, or performance of the Platform or its underlying infrastructure.
• Illegal Activity: Using the Platform for any purpose that is unlawful under applicable Indian law or international law.

Violations of this section may result in immediate account suspension or termination, at our sole discretion.

7. Intellectual Property

All content, features, functionality, design elements, trademarks, logos, and source code of the Platform (collectively, "Platform Content") are the exclusive property of AptLok or its licensors and are protected by applicable intellectual property laws.

• You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any Platform Content without our prior written permission.
• Users retain ownership of the content they submit to the Platform, including property listing descriptions, images, and other user-generated content. By submitting content, you grant AptLok a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute such content in connection with the operation and promotion of the Platform.
• You represent and warrant that you have all necessary rights to the content you submit and that such content does not infringe upon the intellectual property rights of any third party.

8. Limitation of Liability

The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

• AptLok shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Platform.
• We are not a party to any transaction between users and bear no responsibility for the quality, safety, legality, or any other aspect of properties listed on the Platform or transactions conducted between users.
• AptLok does not verify the identity, credentials, or representations of any user, agent, or property listed on the Platform.
• In no event shall our total aggregate liability exceed the amount you have paid to AptLok, if any, in the twelve (12) months preceding the claim.

9. Termination

AptLok reserves the right to suspend, restrict, or terminate your account and access to the Platform at any time, with or without cause, and with or without notice, including but not limited to the following circumstances:

• Violation of these Terms or any applicable laws or regulations.
• Conduct that we determine, in our sole discretion, is harmful to the Platform, other users, or third parties.
• Extended periods of account inactivity.
• Requests by law enforcement or government authorities.

Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall remain in full force and effect.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

11. Changes to Terms

We reserve the right to update or modify these Terms at any time at our sole discretion. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the Platform after the revised Terms have been posted constitutes your acceptance of the updated Terms.

We encourage you to review these Terms periodically to stay informed of any changes. Material changes may be communicated through a notice on the Platform or via email to registered users.
